Kansas City Homebuilder plans appeal:

Last week’s not guilty verdicts for Kansas City area homebuilder F. Jeffrey Miller may help in a planned appeal of the related case in which he already had been convicted, Miller’s attorney said Tuesday. The sweeping acquittal provides no legal case to challenge the earlier convictions, but “it is a nice atmospheric, that’s for sure,” said Jeff Morris, with the firm Berkowitz Oliver Williams Shaw & Eisenbrandt LLP.

Miller was acquitted of 59 felony charges that stemmed from a May 2006 indictment that claimed he had run a “fraudulent real estate machine.”

He still faces sentencing, however, for convictions from a December 2008 trial on charges in a related second indictment. Morris, who was not involved in the 2008 trial, said he sees several areas to appeal the convictions."
