My Realtor listed my Overland Park home for $5,100 dollars less than I signed the listing contract. In addition, according to the listing sheet my home is a short sale and I'm desperate for an offer. Can I get out of the listing contract?

Question: My Realtor listed my Overland Park home for $5,100 dollars less than I signed the listing contract. In addition, according to the listing sheet my home is a short sale and I'm desperate for an offer. Many of the room measurements are incorrect and my home is a 4 bedroom, 3.5 bathroom with a 3 car garage, not a 4 bedroom, 2.5 bathroom with a 2 car garage. I feel that the marketing on my home by my real estate agent will yield poor results. I haven't had any showings on my home for the first 3 weeks it has been listed. Can I get out of the listing contract?

Answer: If you saw the information on a syndication site like Zillow or Trulia, there is a possibility that the listing information was pulled incorrectly. Ask for a printout of the MLS sheet from the MLS. If the information is indeed incorrect, have a talk with your real estate agent. If the problem is not corrected promptly, discuss the problem with your real estate agents managing broker.


A listing contract is a contract. If you want to cancel the contract without the other party agreeing to the cancellation, you will need an attorney.


When listing a home in Overland Park, Kansas, it is important to review the marketing plan prior to listing with your real estate agent. Breaking a listing agreement may cost you marketing time and money to cancel the agreement.
