I have a short sale question on our Gardner, Kansas home

Q: I noticed that you do a few short sales so I have a question for you. I was selling my Gardner home as a short sale for the past 1.5 years. My husband and I signed four individual real estate contracts with four individual home buyers. All of the home buyers agreed to a sales price and made a deposit. I was just notified by my mortgage lender that they refused all of the offers. They didn't even counter back. Who is responsible to sign and release the earnest deposits?  My husband and I think that since it took so long, we should get the deposits.

A: Short sale contracts in Kansas City, including Gardner, Kansas, are normally contingent on the bank's approval. You the seller, and your buyers, should sign the release agreement and move on.Your mortgage lender has nothing to do with this and earnest money deposit check should go back to the buyers. In addition, since the contracts were subject to lenders approval, the buyers should get their entire earnest money deposit back.
