The Kansas Supreme Court makes decision in dispute over a real estate brokerage commission

The Kansas Supreme Court affirmed a Johnson County, Kansas decision in a dispute over a real estate brokerage commission. The district court ruled that an attorney who is not licensed under the Kansas Real Estate Brokerage and Salespersons License Act cannot share in a real estate brokerage commission. In the case of Stewart Title of Kansas City vs. Reese and Nichols Realtors Inc. and Patrick McGrath, the court determined that a real estate brokerage commission is earned by producing a “ready and willing buyer or seller,” and not by primarily performing services encompassed in the practice of law.
