2) How is the BPO process handled? (If the real estate agent says something like "it just happens" or "the lender orders the BPO", then you may consider looking further)


Why look further? An experienced short sale agent may not have the best path for you to successfully negotiate a short sale on your behalf. Why would you consider an inexperienced short sale agent on such an important issue?

Overland Park Short Sale is Taking Over 9 Months. Why? Overland Park, Kansas Real Estate

Question: My husband and I put a offer on a "Short Sale" home in Overland Park, Kansas 9 months ago and we have heard very little from the seller's lender. With all of the changes in short sales and supposedly banks are to respond within 60 days, how is that possible? Why is taking that long? Sometimes I think our Realtor is not really helping us. What should we do? Walk away and try to find another house in Overland Park or Olathe or stick it out? How much longer do you think it will take?

Answer: Sorry to hear about your frustration about buying a short sale in Overland Park, Kansas. First, the REALTORS are communicating probably with the mortgage servicer, not the mortgage lender. Why does this matter? It takes 30-90 days for the mortgage servicer to complete a short sale package and send it to the mortgage lender. If the seller takes longer to provide docs, the BPO (Broker Price Opinion by a Broker) and the appraisal take longer the package takes longer to prepare for the mortgage lender.


Next, once the mortgage lender receives the short sale package, the negotiator does their research. The negotiator will start communicating with the insurance companies, lien holders and additional mortgage companies involved. The more entities involved the longer the process will take. I had a short sale that had 3 mortgage companies, 2 insurance companies and 4 lien holders involved. This file took nearly 2 years to close because of the many entities involved and the constant need to update documents from the seller. The buyer stayed in contract because we provided communication and the buyer was getting an awesome deal.


The negotiator will also look at the homes value, amount being written off and the sellers hardship. If any of these don't make sense, the short sale will probably not be granted. That means if the seller has $50,000 in the bank and the home appraised $100,000 above the contract price, the negotiator will probably not grant the short sale.


Not all short sales are the same. There are simple pre-approved portfolio short sales that take less than 1 month to close to complicated short sales as mentioned above. It is best to find out how many entities are involved, how much is being written off and what is the sellers hardship for requesting the short sale.


Since less than 25% of the short sales close that take longer than 6 months, I would say that if you don't get the answers needed, I would move on.

I lost my job 3 months ago and I'm now behind on my mortgage on my home in Olathe, Kansas. I knew there was a possibility that I would lose my job so I started working on a loan modification a couple months before I lost my job. I have not heard anything about my loan modification for the past 3 months and then yesterday I received a notice that my lender is starting to foreclose on my home. What are my options?

Answer: Sorry to hear about your problem, Danny. According to AmHerst Securities Group who has monitored thousands of mortgages, 95% of the mortgages that are 60 days delinquent never were brought current nor where successfully modified. If a mortgage is 90 days delinquent, the percentage of mortgages never brought current or successfully modified was 99.2%.




Danny, if your mortgage falls into anyone of these categories and you have been trying to negotiate a loan modification and have been unsuccessful, I would suggest negotiating a "Short Sale". 


If you decide that a short sale is the best path, the Dowell Taggart Team would be available to assist you. If you decide to interview real estate agents, keep in mind the two most important questions when hiring a short sale agent.

I have a home in Overland Park that I owe $367,000 on and it was recently appraised for a refinance for $325,000. I had my home appraised to lower the monthly payment and complete some deferred maintenance. I need a new roof, furnace, a/c, paint and carpet. Since I can't fix up the home now and can't sell for my loan amount, what should I do? I do not have the money to make the repairs and make the monthly mortgage payment. I feel like I continually fall further and further into debt. I would really like to sell but the only way I see this happening is to do a short sale. I would like to rent a home at a lower monthly payment to build up credit before purchasing a new (more affordable home) within the next five years.

Answer: Sorry to hear about your problem Kenny. If you can prove a financial hardship, you maybe able to short sale your home in Overland Park, Kansas. But before you start a short sale, I would contact your lender and request a loan modification. Maybe your lender can help. If not, a short sale maybe the only answer.

Answer: Great question Jamie. In order for a bank to accept a short sale, the homeowner will need to demonstrate a financial hardship. In my experience, I have seen many different reasons for homeowners to suffer a financial hardship. Some common reasons why homeowners suffer a financial hardship are medical illness, medical injury, loss of job, job transfer, deferred maintenance on the home, increased debt and so forth. There is no single reason why a Kansas City homeowner request their lender for a short sale.

I'm in the process of buying the home I rent in Overland Park, Kansas. The problem is my landlord is selling the home as a "Short Sale."

Question: I'm in the process of buying the home I rent in Overland Park, Kansas. The problem is my landlord is selling the home as a "Short Sale." My landlord’s real estate agent has prepared a hardship letter to his loan company asking them to accept a short sale… but he said that she needs us “the potential buyers” to get a prequalification letter from our mortgage lender. We got pre-approved for a mortgage in the amount the home is listed and sent it to the landlord's real estate agent. The real estate agent said he wants to show the mortgage lender that “the potential buyer is willing and able to pay the current assessed value of the home.” Is this normal or what? I just want to hear what someone else that is in the business thinks. Thanks.

Answer: It’s normal if you really want to buy the home and can really afford the home. When a short sale is being considered the mortgage company will look at the purchase contract between landlord and you, the potential home buyer. The mortgage lender wants to view the pre-approval letter, copy of the earnest money deposit in escrow, and the sales contract.

My wife and I bought our home in Olathe in 2007. This spring we got a divorce. Recently, I have been laid off from work and can't keep up on the mortgage. I offered to let my ex-wife have the home, but she is not in position to make the mortgage either. I had an appraisal done on the home and found out that my home is worth much less than what I owe on the home. What can I do?

Answer: Sorry to hear about your situation, Jeremy. Although I would prepare for a short sale, I would first request a loan modification from your lender. Your lender should offer some options. Mortgage lenders are getting much more aggressive in working out short sales in Kansas. Since time is of the essence, I would also hire a real estate agent who specializes or has experience with short sales immediately.
