Dog in Olathe is attacking my kids - Help!

Question: I read your post last week about barking dogs. I have a bigger problem. My new neighbors small dog climbs the fence and attacks my kids in my backyard. Almost daily my wife or I have to corral the dog and put it back in the neighbors yard. We have repeatedly  spoken to the neighbor but nothing gets done. What can I do? I live in Olathe, Also.

Answer: Sorry to hear about your problem, Kerry. Nobody wants to see their kids attacked.


First, I would talk to your neighbor once more and follow up with a letter. If the neighbor does not take care of the situation, contact the Olathe Animal Control when the dog leaves your neighbors yard. The Olathe Animal Control will talk to your neighbor and may issue warnings or fines if needed. Olathe Animal Control will also be happy to discuss with you your possible options.

First Time Home Buyer Bought a Nightmare in Olathe, Kansas - Please stop the barking dogs!

Question: I bought my first house in Olathe last year and it is becoming a nightmare. Since I have moved in, I have not had one night of good sleep because the neighbors four dogs bark all night. Id there anything I can do?

Answer: So you bought your first house and it is a nightmare, Jack. Sorry to hear that. Buying a home should be a pleasant experience, not a nightmare.


First, I would talk to your neighbors and see if they might understand and bring the dogs in at night. If that doesn't work, don't worry, you have options.


First, you can file a complaint with animal control. Animal control will send a "No Barking Letter" to the homeowner. Typically a fine or two will get the homeowner to cooperate. Keep contacting animal control until the barking stops.


Next, you can contact animal control about the neighbors having four dogs and see if your neighbor has a special use permit. If the homeowner does not have a special use permit, they can be cited and issued a fine.


Homeowners who have been in your situation tell me that these two options work.

I bought a vacant foreclosure home in Olathe and I have now discovered that I have a zoo in the home and I need help removing the animals. I'm sure I have more but I have seen bats in the attic, squirrels above the garage, birds in master bedroom, mice in the kitchen and snakes in the basement. Who do you recommend to remove these animals?

My husband came home from work last night and said that he has been offered a relocation opportunity to one o three places. Where can I find information about Olathe, Kansas?

I've been trying to find out about conditions in an area. I’ve contacted the Chamber of Commerce,the Police Department and and the City of Olathe.They all tell me that the law won’t let them tell me about crime rates, types of shopping and sexual predators in the area. I’ve also asked a couple Olathe Realtors and they say they don’t have that kind of information, but they have homes listed there. Where can I find information about Olathe, Kansas?

Answer: Hi, Congratulations, Lisa, on making a decision to buy a house. Since homes in Olathe are selling quickly, I would recommend contacting a buyers agent 4-6 months before you are wanting to move. Since June is within 6 months, I would start interviewing buyers agents in the next week. Talk to several buyers agents and find one that clicks with you and that you feel will help you find the perfect house for you. The process of finding a home can take 1-2 months and the process to close a non-distressed house can take 20-45 days.

Question: Last fall I bought a home in Overland Park. I did not move in right after closing because I had to sell my home I was living in.  During the negotiations of our home I reviewed the sellers disclosure and even discussed it with my inspector while he was inspecting the home. The inspector noted a few issues, but overall I was happy with the home. Once I moved into my new home, I found out that I bought a "Money Pit." I have found out from neighbors and contractors that the seller knew of major problems in the home, but have never disclosed. We even found out that a rabid bat killed the previous families dog. We have discovered bats living in our attic. What can we do?

Answer: I would first have a discussion with your agent, if you had one. If you did not have an agent have a discussion with the listing agent and their broker. If a suitable remedy can't be reached, I would recommend talking to an attorney. There sounds like some serious issues that have not been disclosed by the seller. I once had one of my buyers in a similar situation. My client won a very sizable award in court. Best of luck!

Last fall I had my home in Olathe on the market and it did not sell. The feedback from real estate agents was mostly negative.

I heard that my green counter tops in the kitchen, pink walls in the bedrooms and my decor turned buyers off. I plan on putting my home back on the market this spring. Do you think it is better to neutralize my home or offer a decorating allowance?

Answer: As a real estate agent, I get asked this question quite frequently. First, if you offer a decorating allowance, buyers will still not see past the decor choices. I recommend using neutral color choices on your home. Specialized colors and decor choices will cut down on the number of buyers, even if you're offering a decorators allowance. Buyers can't see past what they see. I would recommend having a staging expert view your home and have them recommend specific options for you.

I made an offer on an Olathe foreclosure home last December. I just found out that the bank has canceled the real estate contract days before closing. Can they do this?

Question: As a first time home buyer I was excited to being able to buy my first home. I made an offer on an Olathe foreclosure home last December. In January my offer was accepted by the bank and so my real estate agent recommended that we complete our inspections. My agent sent me a signed contract with a stamp from the bank in the sellers section. I completed my inspection and I was ok with the outcome. I have been on cruise control until last Friday, a week before closing. I was notified by my real estate agent that the bank has denied the purchase. When I asked why, I found out that the bank has thrown out my offer and has accepted a cash offer. How can the bank throw out my offer and accept another offer on the home I was purchasing in Olathe? Also, what about my inspection and appraisal fees? I found out that the cash buyer is using my appraisal and inspection. This burns me up. What can I do?

Answer: Banks think they are above the rules and don't operate by the same rules and laws as people. I would take your contract to an attorney to have it reviewed. I know some banks use specific addendums that allows them to cancel the real estate contract any time and without penalty. I hope this is not the case with your real estate purchase contract.

I'm a first time home buyer and found a home in Olathe, Kansas while I was driving around. I called the listing agent on the sign and she agreed to show me the home last Thursday.

Question: I'm a first time home buyer and found a home in Olathe, Kansas while I was driving around. I called the listing agent on the sign and she agreed to show me the home last Thursday. According to the listing agent she had nothing working on the home. I informed her while I was looking at the home that I had a buyers agent and tried calling her but was unable to get a hold of her. I thought since she was the listing agent she would be happy to show me the home. Was I wrong. My agent presented an offer on the home that evening and the listing agent will not agree to present the offer until I agree to pay a an additional commission. Can she do this?

Answer: In Kansas the real estate agents have a duty to present all offers in a timely matter. The listing agent should present the offer to the seller. You informed the listing agent that you are working with a buyer's agent so I feel you informed the listing agent prior to creating a relationship with the listing agent. I would request proof that the offer has been presented to the seller. If you don't get proof, I would contact the listing agents broker. If the broker doesn't offer a satisfactory remedy make a complaint to the KCRAR real estate board and the Kansas Real Estate Commission. If you don't like the outcome from the board and commission or don't feel they will work in a timely manner, I would suggest contacting an attorney.

I signed a contract to sell my home in Olathe a couple weeks ago and now I am having second thoughts.

Question: I signed a contract to sell my home in Olathe a couple weeks ago and now I am having second thoughts. I wanted to sell my home in Olathe, Kansas because I am recently divorced and making the monthly mortgage payments is a little stretch. I wanted to buy a smaller home in Olathe, but I haven’t found anything I like or will cheap enough to lower my monthly payment. It doesn't make sense to me to move to a smaller home and pay the same monthly payment. What would happen if I got out of the contract? Would I owe the Realtor anything? Should I look at refinancing as an option to lower my current mortgage?

AnswerThere is a reason the paperwork you signed is called a contract. A contract is an agreement by two  parties that have their understanding down in writing, signed their names and are bound by it. Unless there is a provision in the agreement that lets you back out, then I don't see an easy way to get out. I would first meet with your REALTOR and discuss with them your situation and see what they recommend. If I were your agent, I would hope that you would come to me with all of these questions and let me guide you to the right result for you. As an exclusive buyer’s agent, I feel that is my job.


If a remedy is not worked out with your buyers agent, you may need to consult an attorney. If you don't have an attorney, I would recommend contacting Mark Molner. Mark can be reached at 800-884-6000.

By dealing with a listing agent from the same company as our buyers agent, we need to pay $14,000 more for the same home


Question: My wife and I hired an agent in Olathe to find our family a home in Olathe. It just so happens to be that we found a home that is listed with my buyer's agent company. After making an offer, the seller countered. My wife and I agreed and my buyers agent sent me the paperwork to have us sign. She also need to get some additional docs like an updated pre-approval letter from us. My wife and I signed the paperwork and included our estimated buyers closing cost and another copy of our pre-approval letter (which showed a much higher sales price than the one given to the listing agent) and I dropped the paperwork off at my agents office that night. Now here is the problem. The seller cancelled their counter-offer and countered at our top dollar which was on our updated pre-approval letter. After discussing with my agent, we think the paperwork that I dropped off at her office actually went to the listing agent. My agent said that the envelope was opened when she got it out of her office mailbox. It seems that this mistake is costing us $14,000. Isn't there a major problem with this real estate office by sharing personal documents? Is there anything we can do?

Answer: Sorry to here about your problems Jack and Brenda. Documents should not be shared within a real estate office. This you actually need advice that is beyond the scope of a real estate agent. I would consult an attorney ASAP. Sounds like there are many things going on in your question. If you don't have a real estate attorney, I recommend giving Mark Molner a call.
