I am purchasing a single family foreclosure home in Kansas City that is bank owned and there is a delay in closing due to the title

Question: I am purchasing a single family foreclosure home in Kansas City that is bank owned. According to neighbors, the home that has been vacant for a year and a half. The bank accepted my offer and I submitted an earnest check in early November, 2011. A clear title seems to be the delay. My question is do banks put homes on market without clearing liens and loans?

Answer: Stan, I hope you're working with a real estate agent. If not, your real estate purchase could get tricky. Yes, it is common for banks to put homes on the market before they have clear title. In addition, it is not uncommon for liens to pop up on the home after the foreclosure process. Once the contract was accepted, the contract was probably sent to a title company to start the title process.

As a real estate agent, I have typically have a title company pull a title commitment the first week.Also typically before closing, I will get a call from the title company that a lien as just been issued on the foreclosed home. The liens can be tax liens, home association liens or a mechanic liens. In addition, sometimes, the title was not cleaned up when the home was foreclosed on by the bank and the title company may have missed the liens.

On a foreclosure home, the liens should be cleared up fairly fast. If they are not, as in your case, I would suggest contacting the title company directly and ask them why there is a delay in closing. Maybe paying off a small lien can solve the problem.

Active = Property for sale, a home buyer can still make an offer to buy the property.

Pending = Property still technically for sale; however, the homeowner has accepted an offer. A transaction stays “pending” until the buyer actually closes on the property.

Backup = Although the homeowner has accepted an offer on the home, they will accept a backup offer. Homeowners usually do this when they have a belief that the contract may cancel. Many times short sales are placed on a Backup status until the lender accepts the terms of the contract.

Answer: Unfortunately, Charlene, I'm going to be the bearer of bad news. In the past, a home buyer could apply for a mortgage 6 months out of bankruptcy. Today, a home buyer needs to wait 2 years out of bankruptcy to start the application process to purchase a home.

Failed Olathe Home Sale Made Me Happy - Olathe, Kansas Real Estate

Yesterday I was called by a past Olathe home buyer. She said that she needed to determine the value of her home and possibly sell soon.

When I got to the home the next day my past home buyer told me that her husband asked for a divorce a few days ago and she would not be able to keep making the mortgage payments.

After I helped determine the value of her home and explained what steps we needed to do in order to sell, I sent her the following story from my computer:

When I got home from work as my wife served dinner, I held her hand and said, I’ ve got something to tell you. She sat down and ate quietly. Again I observed the hurt in her eyes. Suddenly I didn’t know how to open my mouth. But I had to let her know what I was thinking.

I want a divorce. I raised the topic calmly. She didn’t seem to be annoyed by my words, instead she asked me softly, why? I avoided her question. This made her angry. She threw away the chopsticks and shouted at me, you are not a man!

That night, we didn’t talk to each other. She was weeping. I knew she wanted to find out what had happened to our marriage. But I could hardly give her a satisfactory answer; she had lost my heart to Jane, a work associate.

I didn’t love her anymore. I just pitied her! With a deep sense of guilt, I drafted a divorce agreement which stated that she could own our house, our car, and 30% stake of my company. She glanced at it and then tore it into pieces. The woman who had spent 25 years of her life with me had become a stranger. I felt sorry for her wasted time, resources and energy but I could not take back what I had said for I loved Jane so dearly. Finally she cried loudly in front of me, which was what I had expected to see. To me her cry was actually a kind of release.The idea of divorce which had obsessed me for several weeks seemed to be firmer and clearer now.

The next day, I came back home very late and found her writing something at the table. I didn’t have supper but went straight to sleep and fell asleep very fast because I was tired after an eventful day with Jane. When I woke up, she was still there at the table writing. I just did not care so I turned over and was asleep again. In the morning she presented her divorce conditions: she didn’t want anything from me, but needed a month’s notice before the divorce. She requested that in that one month we both struggle to live as normal a life as possible. Her reasons were simple: our eldest son had his final high school exams in a month’s time and she didn’t want to disrupt him with our broken marriage. This was agreeable to me. But she had something more, she asked me to recall how I had carried her into out bridal room on our wedding day. She requested that every day for the month’s duration I carry her out of our bedroom to the front door every morning. I thought she was going crazy. Just to make our last days together bearable I accepted her odd request.

I told Jane about my wife’s divorce conditions. She laughed loudly and thought it was absurd. No matter what tricks she applies, she has to face the divorce, she said scornfully.

My wife and I hadn’t had any body contact since my divorce intention was explicitly expressed. So when I carried her out on the first day, we both appeared clumsy. Our son clapped behind us, daddy is holding mommy in his arms. His words brought me a sense of pain. From the bedroom to the sitting room, then to the door, I walked over ten meters with her in my arms. She closed her eyes and said softly; don’t tell our son about the divorce. I nodded, feeling somewhat upset. I put her down outside the door. She went to wait for the bus to work. I drove alone to the office.

On the second day, both of us acted much more easily. She leaned on my chest. I could smell the fragrance of her blouse. I realized that I hadn’t looked at this woman carefully for a long time. I realized she was not young any more. There were fine wrinkles on her face, her hair was graying! Our 25 year marriage had taken its toll on her. For a minute I wondered what I had done to her.

On the third day, I felt something in my stomach that I hadn't felt in a long time.

On the fourth day, when I lifted her up, I felt a sense of intimacy returning. This was the woman who had given twenty five years of her life to me.

On the fifth and sixth day, I realized that our sense of intimacy was growing again. I didn’t tell Jane about this. It became easier to carry her as the month slipped by.

Perhaps the everyday workout made me stronger. She was choosing what to wear one morning. She tried on quite a few dresses but could not find a suitable one. Then she sighed, all my dresses have grown bigger. I suddenly realized that she had grown so thin, that was the reason why I could carry her more easily. Suddenly it hit me… she had buried so much pain and bitterness in her heart.

Subconsciously I reached out and touched her head. Our son came in at the moment and said, Dad, it’s time to carry mom out. To him, seeing his father carrying his mother out had become an essential part of his life.

My wife gestured to our son to come closer and hugged him tightly. I turned my face away because I was afraid I might change my mind at this last minute. I then held her in my arms, walking from the bedroom, through the sitting room, to the hallway. Her hand surrounded my neck softly and naturally. I held her body tightly; it was just like our wedding day. But her much lighter weight made me sad.

On the last day, when I held her in my arms I could hardly move a step. Our son had gone to school. I held her tightly and said, I hadn’t noticed that our life lacked intimacy.

I drove to office…. jumped out of the car swiftly without locking the door. I was afraid any delay would make me change my mind…I walked upstairs. Jane opened the door and I said to her, Sorry, Jane, I do not want the divorce anymore. She looked at me, astonished, and then touched my forehead. Do you have a fever? She said.

I moved her hand off my head. Sorry, Jane, I said, I won’t divorce my wife. My marriage life was boring probably because she and I didn’t value the details of our lives, not because we didn’t love each other anymore. Now I realize that since I carried her into my home on our wedding day I am supposed to hold her until death do us apart.

Jane seemed to suddenly wake up. She gave me a loud slap and then slammed the door and burst into tears. I had an awkward feeling and couldn't work so I left the office. I first stopped by the floral shop on my way home. I ordered a bouquet of flowers for my wife. The salesgirl asked me what to write on the card. I smiled and wrote, I’ll carry you out every morning until death do us apart.

I then stopped by the mall to get her a couple new dresses. I knew she would probably take them back, but I thought she would appreciate the thought.

I stopped by Hallmark and got her a card and some nice wrapping paper. After explaining my past month to the saleslady she offered to wrap my presents. I took her up on it and they looked spectacular.

Before I knew it it was nearly dinnertime.

When I arrived home, flowers and gifts in my hands, a smile on my face, I ran up stairs, only to find my wife in the bed. Her body was lifeless. She had passed on.

My wife had been fighting CANCER for months and I was too busy with Jane to even notice. She knew that she would die soon and she wanted to save me from whatever negative reaction it would have on our kids, in case we pushed through with the divorce. —At least, in the eyes of our kids—- I’m a loving husband….

Laying beside her was a letter to me.

I couldn't finish the letter. She thought of everyone else more than herself. Even at the end.

THE SMALL DETAILS OF YOUR LIVES ARE WHAT REALLY MATTERED IN OUR RELATIONSHIP. "IT'S NOT" the Mansion or House, the Car, Property, the Money in the bank. These create an environment conducive for happiness but cannot give happiness in themselves. So find time to be your spouse’s friend and do those little things for each other that build intimacy. Do you have a real happy marriage? Sure there are ups and downs, but there is a reason why you got married. Something brought you together. If you don’t share this, nothing will happen to you. If you do, you just might save a marriage. Most of life’s failures are people who did not realize how close they were to success when they gave up... YOU DON'T REALIZE WHAT YOU HAVE UNTIL ITS GONE

Think of what you can do today for your spouse. It is never to late.

Yesterday I got a call from the husband. He said "Thank You." He then said, " We've decided not to sell our home."

Although I had lost a sale, I was happier than a kid in a candy store.

Answer: Good thing you sold your home as a short sale versus letting it get foreclosed on. If it was foreclosed on, you will need to wait at minimum 3 years and with some mortgage products, 4 years. Before you jump into buying a home, its a good idea to ensure you’ve taken corrective action regarding what caused you to be late on your payments on the previous home you owned in Gardner. Talk to a lender to see if you meet the requirements to purchase again. The criteria is much stricter today to buy a home then it was last year. Many lenders will require you to wait 2 years and have no late pays before you're able to buy a home again. I hope you will have a better experience in the future.

You may also look into the USDA RD loan. It has less restrictive loan qualifications for Gardner home buyers.

Winter Maintenance Projects Around Your Kansas City Home

Although Kansas City has been dodging the typical winter weather of cold air, icy roads and winter snow blizzards, homes in Kansas City may require some extra attention when it comes to maintenance to protect itself against the cold, harsh weather. The cold weather will come.

Here are some maintenance tips for the winter months in Kansas City:

Keep out the drafts - Twice a year check your windows and doors for any air leaks, and add caulking, if needed. If extra caulking won’t suffice and you don’t have the money for a replacement, consider adding a storm door to keep out drafts or at least purchasing a draft blocker, which lies at the bottom of your door to block out the cold air. The extreme temperatures we have had lately in Kansas City can really mess up our windows and doors.

Check the heating system - Central heat and air conditioning units need to be checked over. If you have had a furnace checkup, it is never to late. It is better to have the furnace checked out now, than during the time when we have some subzero temperatures and the furnace has malfunctioned. Well-serviced air conditioners and furnaces will save you fuel and money.

Assess the ductwork - Make a trip to the attic or basement and view the ductwork. Make sure that all parts haven’t become disconnected as well as a critter have’t chewed through any duct work.

Clean the gutters - Gutters can become clogged of leaves or other debris. When that happens, they can hold water, which can eventually rot away the siding or roof of your home. Make sure to keep the gutters clean.

Prevent freezing pipes - After walking into a vacant home last week and witnessing a water fall in the living room from a frozen water line, keeping the water lines warm is a must when the temperatures drop below freezing. Let faucets drip, wrap up pipes in unheated rooms and unhook all outdoor lawn hoses. When the temperature really drops set the thermostat a little higher. One broken water pipe will be more costly than an a few days with the thermostat set at a higher temperature.

Answer: Well Greg. You're not going to like my answer. Yes, your lender has the right to foreclose on your Overland Park, KS. house and order the Johnson County Sheriff to auction off your house to recover losses.

I would first recommend contacting an attorney to help you. If you do not know of a good attorney. I'll recommend one at the end of my answer. In Kansas, a mortgage lender has strict guidelines on how to foreclose on your house. Next, after the sheriff sale, a Kansas homeowner has at minimum of 90 days to redeem the sale.

Question: We have made an offer on an Olathe, KS. home that is a short sale. As of today, the seller has approved the offer but the seller's lender has not. We are aware of how long short sales might take so we have been keeping an eye on other homes in our price range. Another home in Olathe just came up for sale and my husband and I are very interested in making an offer. Would we need to withdraw our current offer on the other house first? My husband is thinking that it is ok to make multiple offers on different homes and wait for one of them to get accepted. Any advice?

Answer: Yes you need to cancel the first offer before you make another offer unless you intend to buy both homes.

It is important to remember that your first offer is a binding contract and the seller is expecting you to perform and make good on your intention to purchase. If you back out, it’s also important to remember that it affects many people (including those who have already spent many hours working on the transaction such as title officers, lender, bank personnel, real estate agents, etc.) as well as the seller who could face a foreclosure if there is not enough time left to resell the property after cancelling the offer.

Unfortunately in this real estate market we see a lot of this going on and some buyers treat buying distressed homes like a game. They are always looking for the next best thing and not being willing to stick by their decision until completion. It’s hard to know they do not value the time or hard work of those trying to help make dreams come true. I have heard of some buyers putting multiple offers on many short sales and playing the waiting game. First bank that approves they will accept and they will cancel all of the other offers.

In addition, I had a short sale with Wells Fargo that was sent to the legal department for 2 months because the negotiator found out that the buyer had multiple offers on homes. I was told after the file closed that the mortgage lender was preparing to present a case to a district attorney regarding what the buyer was doing.

I appreciate that you’ve taken time to think about it and ask the opinion of others because it shows your conscientious of your decisions and how they affect others.

Do Kansas City Homeowners who are facing a Bank of America understand their new Cooperative Short Sale Program?

Just as the short sale process was getting its kinks worked out, Bank of America throws a HUGE wrench into the short sale process.

First, Kansas handles their foreclosures through the judicial courts so the new guidelines will affect Kansas differently then other states, like Missouri.

Bank of America has started a new Bank of America's Cooperative Short Sale Program. On the surface it looks very good. They first send out a detailed acknowledgment letter explaining their new short sale program.

In the letter, sent by Bank of America, the front page is very similar to the steps of a normal short sale. The second page is very informative. I even like their short sale disclosures.

The part of the new Bank of America Short Sale Program I dislike is in order for a distressed homeowner to be accepted into the new short sale program they must agree to a Deed in Lieu of Foreclosure at the 121 day mark if the property is not sold.

That is right. The homeowners who are facing foreclosure and decide to go the short sale route may actually make the foreclosure process much easier for the bank to take back the property.

A typical Kansas City home is on the market longer than 120 days. In some areas like Gardner, KS. the median days on the market is 200 days. Short sales are typically on the market longer than a typical home. Bank of America who to this point as been totally honest and swift in negotiating short sales with distressed homeowners will not agree to start the new short sale process unless the homeowner agrees to give back the home in 121 days. Hmm . . . I would suggest consulting an attorney before agreeing to the new terms.

In Kansas, a homeowner can legally stay in the home during the normal foreclosure process a minimum of 7 months. With an attorney, lengthen the process to a year minimum. I have even seen some homeowners stay in their homes 27+ months.

Why would a Kansas distressed homeowner agree to the new Bank of America short sale guidelines upfront without a contract when it is taking 4+ months to sell an average short sale?

Think about it . . . What happens if the buyer backs out of the contract on the 115 day mark because they think they can get a better deal if the home went back to the bank. I have seen this happen many times. Especially with real estate investors and wish washy buyers. The homeowner will be royally screwed by losing their home with the Deed in Lieu of Foreclosure clause.

Lets say the home buyer wants to renegotiate the contract hours before closing. If the seller doesn't give in, they lose their home with the Deed in Lieu of Foreclosure clause.

I think you get the idea. There are many ways that the home buyer will have the upper hand in negotiating. I have seen to many home buyers pull stunts the last minute and everyone leaves upset and the homeowner loses everything.

The new guidelines will slow down the pre-approval process of Bank of America's Short Sale Program.

If a homeowner does not agree to the new short sale program, they will not be eligible for relocation expenses and the streamlined short sale processing according to Bank of America.

I know there are other differences, but these are the main ones. Before accepting the new terms, I would recommend consulting an attorney. The terms are to fictional and I don't see them working out for the homeowner.
